The professional is the director of the State Bar's Member Assistance Program ("MAP"), a confidential program for impaired members. In 01/08, the professional documented communications from third parties including Complainant that a specific attorney ("Attorney") was abusing alcohol. In response, the professional encouraged Attorney to voluntarily enter MAP. After Complainant initiated her concerns about Attorney, the professional hired Complainant to provide administrative services at his private practice, independent of his MAP duties. In 01/10, Attorney entered MAP and the professional began monitoring/treating her according to Attorney's MAP program. Attorney signed a HIPAA form, which prohibited the professional from disclosing any information about Attorney without a signed release of information authorization. The professional disclosed to Complainant information about Attorney abusing alcohol and actions the State Bar took regarding its investigation of the allegations against Attorney. Board Action 11/15/11 Consent Agreement and Order: probation; within 12 months, take and pass a 3 semester credit hour graduate level behavioral health ethics course; $1,000 civil penalty stayed pending compliance with this consent agreement; shall not provide clinical supervision while subject to the consent agreement. Board Action 04/02/12: The Board released the Licensee from all terms and conditions of the Consent Agreement and Order dated 11/15/11. |
